Purple Ocean — Terms of Service

These Terms of Service (“Terms”) govern your use of trypurpleocean.com (the “Site”) and your purchase or use of products and services offered by Purple Ocean.

Purple Ocean is operated by Hookrate MB, a company established in Lithuania (“Purple Ocean,” “we,” “us,” or “our”).

By accessing the Site, creating an account, placing an order, enrolling in a subscription, or otherwise using our services, you agree to these Terms and to any policies incorporated into them by reference.

If you do not agree to these Terms, please do not use the Site or purchase our products.

1. Eligibility

You must be at least 18 years old, or the age of legal majority where you live if higher, and have the legal capacity to enter into a binding agreement.

You agree that information you provide when ordering, creating an account, managing a subscription, or contacting us will be accurate and complete.

Purple Ocean products are offered for personal consumer use unless we expressly agree otherwise in writing.

2. Dietary Supplement and Health Information

Purple Ocean products are dietary supplements intended to support general wellness.

Information on the Site, including product descriptions, ingredient information, articles, educational content, advertisements, testimonials, and other materials, is provided for general informational purposes only and is not medical advice.

Purple Ocean products and Site content are not intended to diagnose, treat, cure, or prevent any disease.

You should consult an appropriate healthcare professional before using a dietary supplement if you are pregnant, nursing, taking medication, have a medical condition, or have questions about whether a product is appropriate for you.

Individual responses to dietary supplements vary. We do not guarantee any particular health, sleep, stress, wellness, or other result.

Testimonials, customer reviews, case examples, and individual experiences represent the experiences of particular individuals and do not guarantee that you will achieve the same or similar results.

3. Product Information

We work to provide accurate information about our products, ingredients, pricing, availability, packaging, and offers.

However, the Site may occasionally contain typographical errors, technical errors, outdated information, or inaccuracies.

Product packaging, design, appearance, or other non-material details may also change from time to time without materially changing the product.

We reserve the right to correct errors, update information, change product descriptions, and correct pricing or availability where appropriate.

If an error materially affects an order you have already placed, we may contact you, correct the error where permitted, or cancel the affected order and refund any applicable amount paid.

4. Orders and Order Acceptance

Submitting an order does not guarantee acceptance.

We may decline, hold, limit, or cancel an order where reasonably necessary, including in cases involving suspected fraud, unauthorized transactions, pricing errors, product unavailability, inaccurate payment or shipping information, unusual order quantities, unauthorized resale, discount abuse, or other suspected misuse.

If we cancel an order after payment has been successfully collected and no amount is otherwise properly due, we will refund the applicable amount to the original payment method.

Once an order has entered processing or fulfillment, we may be unable to modify or cancel it.

5. Prices, Payment, and Taxes

Prices are displayed in U.S. dollars unless otherwise stated.

By providing a payment method, you represent that you are authorized to use it and authorize us and our payment service providers to charge applicable amounts for your purchase.

Depending on the order, charges may include the product price, applicable taxes, disclosed shipping charges, and recurring subscription charges where you have enrolled in a subscription.

You are responsible for providing accurate and current payment information.

We may change product prices from time to time. Price changes do not retroactively change completed purchases.

Subscription price changes are governed by our Subscription & Cancellation Policy and apply to future renewals as described there.

6. Promotions, Discounts, and Special Offers

From time to time, Purple Ocean may offer discounts, introductory pricing, bundles, free products, promotional codes, or other special offers.

Additional terms may be shown with a particular promotion and form part of that offer.

Unless otherwise stated, promotions have no cash value, may not be combined with other promotions, and may be limited by customer, household, shipping address, account, or payment method.

We may reject, reverse, or cancel an order where we reasonably determine that a promotion, discount, referral benefit, or first-customer offer has been obtained through fraud, multiple accounts, false information, unauthorized sharing, resale activity, or other misuse.

7. Subscriptions and Automatic Renewal

Certain Purple Ocean products may be available through automatically renewing subscriptions.

By selecting a subscription and completing checkout, you authorize Purple Ocean and our payment and subscription providers to charge your stored payment method at the recurring price and billing interval disclosed when you subscribe.

Subscriptions continue until cancelled.

Subscription customers may have options to cancel, pause, resume, or skip shipments through the Purple Ocean Manage Subscription portal.

To prevent an upcoming subscription renewal from being processed, applicable cancellation, pause, or skip requests must be completed at least 48 hours before the scheduled renewal date.

We currently send an upcoming subscription charge reminder approximately 3 days before a scheduled renewal.

Additional subscription terms, including processed renewal orders, failed payments, cancellation, pricing changes, and the 90-Day Money-Back Guarantee, are governed by our Subscription & Cancellation Policy.

If these Terms conflict with a more specific subscription term disclosed at checkout or in our Subscription & Cancellation Policy, the more specific subscription term will control for that issue.

8. Shipping and Delivery

Purple Ocean currently ships within the United States.

Current standard shipping terms include free standard U.S. shipping for qualifying subscription orders and a $7.99 standard U.S. shipping charge for one-time purchases, unless a different rate or promotion is displayed at checkout.

Orders are typically processed within 1–3 business days. Once shipped, standard U.S. transit typically takes 3–5 business days.

Delivery times are estimates and are not guaranteed.

You are responsible for providing an accurate and complete shipping address.

Full terms regarding tracking, address errors, carrier delays, lost shipments, returned packages, damaged deliveries, and shipping charges are contained in our Shipping Policy.

9. Returns, Refunds, and Money-Back Guarantee

Returns, refunds, subscription refund eligibility, and Purple Ocean's 90-Day Money-Back Guarantee are governed by our Refund & Returns Policy.

Eligibility for the 90-Day Money-Back Guarantee depends on the purchase type and the conditions described in that policy.

Submitting a return, refund, support, or guarantee request does not automatically cancel an active subscription.

Where cancellation is required as part of an eligible subscription guarantee claim, the customer must complete the applicable subscription cancellation process before the refund can be issued.

Nothing in these Terms limits rights that cannot legally be waived.

10. Product Availability

Products and offers are subject to availability.

We may modify, discontinue, limit, replace, or temporarily suspend products or offers where reasonably necessary.

If we are unable to fulfill an order for a product you have already paid for, we may cancel the affected portion of the order and refund the applicable amount.

For active subscriptions, we may contact you if a subscribed product becomes unavailable or discontinued.

11. Personal Use and Unauthorized Resale

Purple Ocean products purchased through the Site are intended for personal or household use unless we expressly authorize resale or commercial distribution in writing.

You may not purchase our products for unauthorized resale, marketplace distribution, commercial redistribution, or circumvention of purchase limits or promotional restrictions.

We may refuse, limit, cancel, or investigate orders reasonably associated with unauthorized resale, fraud, multiple-account abuse, or circumvention of customer, household, address, payment-method, or promotional restrictions.

12. Accounts and Customer Information

You are responsible for maintaining control of any customer account used to access Purple Ocean services.

You are also responsible for keeping your email address, shipping address, payment information, and subscription information current.

You should notify us if you believe your account or payment information has been used without authorization.

13. Transactional and Marketing Communications

By purchasing from us or maintaining a subscription or customer account, you understand that we may send communications reasonably necessary to administer your relationship with Purple Ocean.

These may include order confirmations, shipping notifications, subscription notices, renewal reminders, payment-failure notices, cancellation confirmations, customer-service communications, product safety notices, or other transaction-related messages.

Marketing emails are governed separately by applicable consent and unsubscribe requirements.

You may unsubscribe from promotional email communications using the unsubscribe link provided in those messages. Unsubscribing from marketing does not prevent us from sending necessary transactional communications relating to your purchases or subscriptions.

14. Intellectual Property

The Site and its contents, including Purple Ocean branding, logos, product names, photographs, graphics, text, design elements, videos, illustrations, software, and other materials, are owned by or licensed to Purple Ocean and are protected by applicable intellectual-property laws.

You may use the Site for personal, non-commercial purposes.

You may not reproduce, republish, distribute, sell, modify, commercially exploit, scrape, or create derivative works from Site content without permission, except where applicable law expressly allows it.

15. Reviews, Feedback, and User Content

If you voluntarily submit a review, testimonial, photograph, video, comment, feedback, or other content to Purple Ocean, you represent that you have the right to provide that material and that it does not violate the rights of another person.

You grant Purple Ocean a non-exclusive, worldwide, royalty-free license to reproduce, display, publish, adapt, and use content you voluntarily submit for legitimate business, customer-service, marketing, advertising, and promotional purposes, subject to applicable privacy and advertising laws.

We are not required to publish every review or submission.

We may remove content that is unlawful, fraudulent, abusive, misleading, infringing, unrelated, or otherwise inappropriate.

16. Prohibited Use

You may not use the Site or our services to violate applicable law, commit fraud, interfere with Site security or functionality, introduce malicious software, impersonate another person, misuse promotions, obtain products through false information, infringe intellectual-property rights, scrape or systematically extract Site content for unauthorized commercial purposes, or engage in unauthorized resale or other activity intended to circumvent these Terms.

We may restrict access, cancel orders, suspend accounts, or take other reasonable action where we believe these Terms have been materially violated.

17. Third-Party Services and Links

Our Site and services may depend on or link to third-party providers, including Shopify, payment processors, subscription-management providers, shipping carriers, analytics providers, review platforms, and other technology services.

We do not control third-party websites or services and are not responsible for their independent content, availability, privacy practices, or terms.

Your use of a third-party service may also be subject to that provider's own terms.

18. Privacy

Our collection, use, and disclosure of personal information is governed by our Privacy Policy.

By using the Site, you acknowledge that personal information may be processed as described in that policy.

19. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Site and its content are provided on an “as available” basis.

We do not guarantee that the Site will always operate uninterrupted, error-free, or without technical issues.

Nothing in this section excludes warranties, remedies, product-quality obligations, or consumer rights that cannot legally be excluded.

Any voluntary product guarantee offered by Purple Ocean is governed by the specific terms of that guarantee.

20. Limitation of Liability

To the maximum extent permitted by applicable law, Purple Ocean, Hookrate MB, and their officers, employees, contractors, service providers, and affiliates will not be liable for indirect, incidental, special, punitive, or consequential losses arising from your use of the Site or products where such liability may legally be excluded.

Our aggregate liability arising from a particular purchase will not exceed the amount you paid to Purple Ocean for the purchase giving rise to the claim, except where applicable law does not permit such a limitation.

Nothing in these Terms excludes or limits liability for fraud, intentional misconduct, or any other liability that cannot legally be excluded or limited.

21. Indemnification

To the extent permitted by law, you agree to indemnify and hold Purple Ocean and Hookrate MB harmless from claims, losses, liabilities, and reasonable costs resulting from your unlawful use of the Site, material breach of these Terms, infringement of another person's rights, unauthorized resale activity, or fraudulent conduct.

This provision does not require you to indemnify us for our own unlawful conduct or where such an obligation would be prohibited by applicable law.

22. Suspension and Termination

We may suspend or terminate access to the Site, customer accounts, promotions, or future purchasing privileges where reasonably necessary because of suspected fraud, unauthorized resale, abuse, security concerns, unlawful conduct, or material violation of these Terms.

Termination does not affect obligations or rights that arose before termination.

23. Changes to These Terms

We may update these Terms from time to time to reflect changes in our business, products, technology, policies, or legal requirements.

The updated version will be posted on the Site with a revised “Last updated” date.

Where required by law, or where a material change affects an active subscription or other continuing contractual relationship, we will provide additional notice.

Changes will not retroactively remove consumer rights that have already accrued.

24. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Lithuania, without regard to conflict-of-law principles, except to the extent that mandatory consumer-protection laws applicable to you require otherwise.

If you have a dispute with Purple Ocean, we ask that you first contact us at hello@trypurpleocean.com and provide reasonable details of the issue so that we can attempt to resolve the matter informally.

If the dispute cannot be resolved informally, either party may pursue available remedies before a court of competent jurisdiction in accordance with applicable law.

Nothing in this section deprives a consumer of any mandatory rights, protections, or forum rights that cannot legally be waived under applicable law.

25. Severability

If any provision of these Terms is found invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted or severed where necessary.

The remaining provisions will continue in effect.

26. No Waiver

Our failure to enforce a provision of these Terms in a particular situation does not waive our right to enforce that provision later.

27. Entire Agreement

These Terms, together with policies and terms incorporated by reference, constitute the agreement between you and Purple Ocean regarding your use of the Site and purchases made through it.

Relevant incorporated policies include our:

Refund & Returns Policy, Shipping Policy, Subscription & Cancellation Policy, and Privacy Policy.

Specific terms disclosed with a promotion, subscription, guarantee, or purchase may supplement these Terms.
